Terms of Service

These Terms of Service ("Terms") govern your use of the ColorWave mobile application ("App") developed by Denis Sviridov ("Developer", "we", "us"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. About the App

ColorWave is a personal coloring book tracker that helps you organize your coloring book collection, track page progress, store photos of your artwork, and share your creations in a community gallery.

2. Eligibility

You must be at least 16 years old to create an account and use the App. By using the App, you represent that you meet this age requirement.

3. Account Registration

• You must provide a valid email address to create an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1. Your Content

You retain ownership of all content you create and upload to the App, including:

• Photos of your coloring pages
• Notes, captions, and descriptions
• Profile information and avatar
• Gallery posts and comments

4.2. License Grant

By uploading content to the App, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and transmit your content solely for the purpose of operating the App and its features. This includes displaying your gallery posts to other users when you choose to share them.

This license terminates when you delete your content or your account.

4.3. Content Responsibility

You are solely responsible for the content you upload. You represent that:

• You own the content or have the right to share it
• Your content does not infringe on any third-party rights
• Your content does not violate any applicable laws

5. Community Gallery Rules

When sharing content in the community gallery, you agree not to post:

• Content that is offensive, abusive, hateful, or discriminatory
• Sexually explicit or violent imagery
• Content that infringes on intellectual property rights
• Spam, advertisements, or promotional material
• Personal information of others without their consent
• Content that is misleading or fraudulent

We reserve the right to remove any content that violates these rules and to suspend or terminate accounts of repeat offenders.

6. Acceptable Use

When using the App, you agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to interfere with or disrupt the App's operation
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated scripts, bots, or scrapers to access the App
• Reverse engineer, decompile, or disassemble any part of the App
• Harass, bully, or intimidate other users
• Impersonate another person or entity
• Circumvent any security or access controls

7. Intellectual Property

7.1. App Ownership

The App, including its design, code, logos, and trademarks, is the property of the Developer and is protected by intellectual property laws. Nothing in these Terms grants you any right to use the ColorWave name, logo, or branding.

7.2. Coloring Book Content

The coloring book catalog data (titles, authors, ISBNs, descriptions) is provided for informational purposes. Copyright for coloring books and their artwork belongs to their respective publishers and authors. The App does not provide or reproduce copyrighted coloring book pages.

8. Blocking and Reporting

• You may block other users to prevent them from seeing your gallery posts and interacting with your content.
• You may report content that violates these Terms or community guidelines.
• We review reports and take appropriate action, which may include content removal or account suspension.
• Abuse of the reporting system may result in action against your account.

9. Account Deletion

• You may delete your account at any time through the App settings.
• Account deletion permanently removes your books, pages, photos, markers, tags, and gallery posts.
• This action is irreversible. Deleted data cannot be recovered.
• We may retain anonymized or aggregated data for statistical purposes.

10. Service Availability

• We strive to keep the App available at all times but do not guarantee uninterrupted access.
• The App may be temporarily unavailable due to maintenance, updates, or technical issues.
• We reserve the right to modify, suspend, or discontinue any part of the App at any time.
• We are not liable for any loss or inconvenience caused by service interruptions.

11. Disclaimer of Warranties

We do not warrant that:

• The App will meet your specific requirements
• The App will be error-free or uninterrupted
• Any data stored in the App will not be lost
• The coloring book catalog information is complete or accurate

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising from your use of or inability to use the App.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App (if any) in the 12 months preceding the claim.

13. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the App, you consent to our data practices as described in the Privacy Policy.

14. Third-Party Services

The App uses third-party services (Supabase, Expo Push Notifications, Google Books API) to operate. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of these services is subject to their respective terms and privacy policies.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after such notification constitutes acceptance of the updated Terms. If you disagree with any changes, you should stop using the App and delete your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the Developer's jurisdiction. Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the Developer's jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
